Apple v Samsung: A Patent Wars Time Line, Part 3

Whew! Thanks again! Upon reviewing all the remaining dates, unfortunately, we cannot say this is the last post of the day for this chronology. We can take this one the end of November, but it looks as though there will be a Part 4 bring this to at least last week.

Around November 10, 2011: Samsung was given Apple’s iPhone 4S’ source code for examination, requested the week prior in Australia. Samsung had also requested Apple’s contracts with telecos, but only part of the information requested was granted. The judge ruled that other elements pertaining to Samsung’s claim that Apple’s demand for preferential treatment were not directly related and temporarily set aside.

November 15, 2011: This day was the approximate start date of the injunction hearing for Samsung’s requested ban on the iPhone 4S. Unfortunately, the temporary injunction hearing had been pushed toward March 2012, granting Apple the right to sell the iPhone 4S in the Australian market until at least the unscheduled hearing date.

November 16, 2011: Back in Germany, Samsung shipped redesigned Galaxy Tab 10.1, now designated in the European theatre as the Galaxy 10.N, to avoid the appearance claim by Apple. Samsung changed the front frame to overlap the display. In a side note, they also boosted the Bluetooth version in the 10.N model to Bluetooth 3.0. [Ed: This was the two-day adjustment that cost Apple $1 million dollars to get in place that was mentioned in yesterday's “Response to Reader Replies” post. The redesign took longer than two days from being approved until it showed on shelves, but the redesign was determined and approved in two days, as far as we can determine.]

November 29, 2011: Apple still thinks the Samsung Galaxy Tab 10.N still infringes upon its design patents and appeals the re-marketing of the device.

November 29, 2011: Samsung won the sales injunction appeal in Australia: The Samsung Galaxy Tab 10.1 was back in business – technically. The court ordered a hold on sales resumption until that Friday, giving Apple time to file an appeal to the country’s High Court.

December 2, 2011: The Australian High Court delays its hearing from today to December 9, 2011, to allow for proper hearing of the case. Meanwhile, Apple provided a list of work-arounds available to Samsung and Apple. We’ll cover that in a later post.
